1. OVERVIEW

This website is operated by Romance on Mars V.O.F., registered in the Netherlands. Throughout the site, “we”, “us”, and “our” refer to Romance on Mars. The term “you” refers to the user, customer, or visitor engaging with our Website. 

By accessing this website or purchasing something from us, you engage in our “Service” and agree to be bound by these Terms of Service (“Terms”), including any referenced or linked policies (such as our Privacy Policy and Returns Policy).

These Terms apply to all users of the site, including but not limited to browsers, customers, vendors, and content contributors. If you do not agree to these Terms, you must not access or use the website or any services.

Our store is hosted by Shopify Inc., which provides the e-commerce platform that enables us to offer our products to you. These Terms apply to all orders placed on romanceonmars.com and form a binding agreement between you and Romance on Mars. 

Romance on Mars is committed to providing a transparent, fair, and lawful online shopping experience. We operate in full compliance with applicable complies with all relevant Dutch and EU legislation, including but not limited to:

  • The Dutch Civil Code (Burgerlijk Wetboek)
  • The Distance Selling Act
  • The EU Consumer Rights Directive
  • GDPR (General Data Protection Regulation)

By browsing, purchasing, or interacting with our site, you confirm that you have read, understood, and agreed to these Terms. We recommend printing or saving a copy of these Terms for your records. 

2. LANGUAGE 

These Terms are provided in English and apply to all transactions made through our Website. 

3. ELIGIBILITY

You must be at least 18 years old to place an order on this website. Orders by automated systems, bots, resellers, or entities acting fraudulently may be rejected.

4. ACCOUNT & ORDERS

You may create a customer account to track and manage your orders. Information provided will be stored securely in accordance with GDPR. The only information that will be stored is the information you provide to your order such as shipping and billing address as well as email address.

If you create an account yourself you will be able to choose a password with which you can log in to your account online and view your order history and track your order. You can request deletion of your account at any time by contacting info@romanceonmars.com. Orders can also be placed without creating an account.

5. ORDER PROCESS

5.1 Placing an Order

By submitting an order, you confirm that you have read and accepted these Terms and our Privacy Policy. You will have the opportunity to review your items, shipping method, and payment details before finalizing the order. Products in your cart are not reserved and may sell out until the order is confirmed. 

5.2 Order Confirmation

Upon placing an order, you will receive an order confirmation email. This does not constitute acceptance.

5.3 Acceptance and Shipping Confirmation

We accept your order and form a binding contract once your item(s) have been dispatched and you receive a shipping confirmation email. Romance on Mars reserves the right to cancel any order prior to this acceptance. 

6. PRICING & PAYMENT METHODS

All prices are listed in Euros (€) and include 21% Dutch VAT unless stated otherwise. Prices do not include shipping or potential customs duties. For orders outside the EU, VAT will be deducted at checkout. You are responsible for any import duties, taxes, or handling fees incurred. Romance on Mars cannot be held responsible for currency fluctuations or bank charges applied during international payments. 

We accept:

  • Credit/debit cards (Visa, MasterCard, American Express)
  • PayPal
  • Klarna (where available)
  • iDEAL (Netherlands)

Payments are processed securely via our third-party payment providers. All transactions are encrypted. The full amount is charged upon dispatch. 

7. SHIPPING

7.1 Dispatch Times

Orders are typically processed and shipped within 5 business days. During peak periods (e.g. holidays or sales), this may extend to 7 business days.

7.2 Delivery

  • Estimated delivery times and shipping rates are shown at checkout.
  • Orders are shipped Monday–Friday, excluding public holidays.
  • You will receive tracking details by email once your order is dispatched.

If your order is not delivered within 30 days, you are entitled to cancel the purchase and request a full refund.

8. PRODUCT AVAILABILITY & DESCRIPTION

8.1 Availability
All items shown on the Website are subject to availability. We reserve the right to limit quantities, discontinue products, or adjust availability at our discretion. If an item is out of stock, you will be informed via email and refunded if payment has already been made. Products are offered as long as stock lasts, and we reserve the right to change descriptions, prices, or availability at any time without prior notice.

8.2 Product Presentation
We strive to accurately display product images and colours, but differences in monitor settings may result in slight variations. These variations are not considered defects.

8.3 Intended Use & Customer Responsibility
All Romance on Mars products , including but not limited to our signature Elevate headwear pieces are designed exclusively as fashion items. By purchasing or using any Romance on Mars product, you acknowledge and agree that you are solely responsible for the manner in which the product is worn, fitted, adjusted, handled, or otherwise used.

8.4 No Liability for Accidents or Injuries
Romance on Mars V.O.F. shall not be liable for any accident, fall, loss of balance, head impact, abrasion, cut, irritation, or other injury occurring while wearing or using our products. This includes injuries resulting from accidental impacts, improper fitting, misuse, product modification, movement or physical activity, or environmental conditions outside our control.

8.5 No Protective Function
Romance on Mars products are not designed or certified as protective equipment and must not be used or relied upon for safety, impact absorption, or injury prevention in any circumstance.

8.6 Assumption of Risk & Limit on Damages
By wearing or using any Romance on Mars product, you voluntarily assume all associated risks and agree that Romance on Mars bears no responsibility or liability for any injury, harm, or damage that may occur. To the fullest extent permitted by law, Romance on Mars V.O.F. is not responsible for consequential or incidental damages, medical costs, loss of income, or any claims arising from the customer’s own actions, behavior, or circumstances while using our products.

9. RIGHT OF WITHDRAWAL & RETURNS

9.1 Withdrawal Period

As an EU consumer, you have the right to withdraw from your purchase within 14 days of receiving your order. You do not have to provide a justification.

9.2 Initiating a Return

To initiate a return, you must contact info@romanceonmars.com within the 14-day withdrawal period. Please include your order number and specify which item(s) you wish to return. We will confirm your request and provide return instructions.

9.3 Return Instructions

Returned items must be:

  • Unused and unworn,

  • In perfect condition,

  • With all original labels and packaging attached,

  • Placed in the original packaging or a sturdy protective box.

Please enclose your return slip in the packaging. Or, if unavailable, your order number and reason for return must be inside the package. The parcel must be sent using a trackable shipping method. You bear the return shipping risk until the package reaches us.

9.4 Return Address

Returns must be sent with tracking. The customer bears the risk and costs of return shipping. For returns from outside the EU, the parcel must be clearly marked as RETURN and the correct value must be declared on customs forms. Failure to do so may result in delays or additional duties.

9.5 Refunds

Once we receive your return, we will inspect the item(s) and process your refund after acceptance within 30 business days. Refunds are issued to the original method of payment.

If your entire order is returned, the original outbound shipping fee will also be refunded, in accordance with EU consumer law.

Return shipping costs and customs duties paid for returning the goods are non-refundable. If the condition of the item has deteriorated beyond what was necessary to examine it, we may deduct a reasonable amount to reflect any depreciation in value.

9.6 Exchanges

Romance on Mars does not offer exchanges. To receive a different item or colour, you must place a new order.

10. DEFECTS & WARRANTY

If an item is defective, notify us immediately at info@romanceonmars.com with photos and your order number. If confirmed, we will offer a refund or replacement (including original shipping costs) in accordance with EU consumer protection law. You may be asked to return the item.

11. UNCLAIMED PACKAGES

Packages returned to us due to non-collection or failed delivery will result in deduction of return shipping fees from your refund.

12. USE OF WEBSITE

You may not use our website or its contents for any illegal or unauthorized purpose. This includes (but is not limited to):

  • Violating any local, national, or international laws or regulations,
  • Transmitting malware or harmful code,
  • Spamming or harvesting data,
  • Infringing on intellectual property rights.

We reserve the right to terminate access for any violation of these Terms.

13. INTELLECTUAL PROPERTY

All content on this site, including images, product descriptions, logos, design, code, and text, is the intellectual property of Romance on Mars and may not be copied, reproduced, distributed, or exploited without prior written permission.

14. PRIVACY & COOKIES

We collect, process, and protect your personal data in compliance with GDPR. For full details, please see our Privacy Policy.

15. LIABILITY

Romance on Mars is not liable for:

  • Indirect or consequential damages,
  • Loss of profit or business,
  • Delays caused by third parties or force majeure (e.g. natural disasters, strikes, government actions, pandemics).

Our liability is limited to the amount paid by you for the order concerned.

16. WEBSITE AVAILABILITY

We aim to keep the website available at all times but cannot guarantee uninterrupted, secure, or error-free operation. Romance on Mars is not responsible for damages arising from website downtime, cyberattacks, or third-party failures.

17. CHANGES TO TERMS

We may update these Terms from time to time. The version that applies is the one you accepted at the time of your order. The current version is always available at romanceonmars.com.

18. GOVERNING LAW & JURISDICTION

These Terms are governed by the laws of the Netherlands. Disputes will be submitted to the competent court in Amsterdam, unless another jurisdiction is required by mandatory consumer protection laws.
